1313 Main Street, Buffalo, NY, Defendant

Whereas, this Court signed an Emergency Demolition Order on December 19, 2001 regarding 1313 Main Street (hereinafter "subject premises"); and

WHEREAS, there are five buildings situated on the property located at the subject premises, which are as follows:

WHEREAS, the City of Buffalo Common Council approved and designated the subject premises as a local historic landmark under the City of Buffalo Preservation Code; and

WHEREAS, the Preservation Coalition of Erie County filed an Order to Show Cause in Erie County Court on December 21, 2001, and was granted a temporary injunction preventing the demolition of the property located at 1313 Main Street, filed in the Erie County Clerk's Office under Index Number 2001-12078; and

WHEREAS, the subject premises is now owned by Bailey Robinson, Inc., who is now a party to the Erie County Court case, as well as the Buffalo Preservation Board; and

WHEREAS, Siracuse Engineers, LLP has prepared a report regarding all the structures situated on the property located at 1313 Main Street, and found the only buildings that require demolition are the Connector Building and the Rear Addition Building.

THEREFORE, the Emergency Demolition Order signed by this Court on December 19, 2001 is hereby modified and this Court Orders the following:

1. The demolition of the Connector Building and the Rear Addition Building only;

2. The demolition of these structures should be done in such as way as to not cause any damage to the George Squier Mansion and any of the remaining structures on the subject premises;

3. The remaining structures on the property located at 1313 Main Street, the George Squier Mansion, the Orphanage Addition Building, the Gymnasium, and the School and Dormitory Building, shall not be demolished unless such demolition is Ordered by a judge of the Buffalo City Court, with prior notice to the Buffalo Preservation Board, and an opportunity for a public hearing on the proposed demolition;

4. The City of Buffalo and/or its agents may demolish the Connector Building and the Rear Addition Building if the current owner of the subject premises, Bailey Robinson,Inc., does not demolish the structures, and Bailey Robinson,Inc. and/or its Agent shall be liable to the City of Buffalo for the cost of said demolition.
